1.1. These terms and conditions (hereinafter referred to as - the “Rules”) govern the main provisions and principles of EASY TO FLY! loyalty program for passengers.
1.2. These Rules are valid from the time of their publication on the website www.nordstar.ru. NordStar JSC reserves the right to change the Rules and conditions of EASY TO FLY! program (hereinafter referred to as the “Program”), including the Program cancellation, either with prior notification or without it, in the manner specified in these Rules and the current legislation.
1.3. To ensure the possibility of each Participant’s timely acquaintance with the amendments to these Rules, relevant announcements as well as the text of these Rules and amendments thereto are published on the website www.nordstar.ru.
1.4. These Rules apply to all participants of EASY TO FLY! program without exception. Participation in the Program is a confirmation of the Participant’s proper familiarization and consent with all provisions of these Rules in accordance with Article 428 of the Civil Code of the Russian Federation.
1.5. These Rules supersede all previous rules related to the Program and have unconditional priority over all previous public statements about the Program made by NordStar JSC.
1.6. Special and additional rules stated in the further documents of the Program and published on the website www.nordstar.ru and in other information materials related to the Program can be applied for EASY TO FLY! program.
1.7. In case of EASY TO FLY! program cancellation Award flight tickets confirmed in accordance with the provisions of these Rules and issued prior to the date of the Program cancellation can be used during their validity period.
1.8. With account of the provisions of item 3.1.4, the Participants’ personal data related to participation in the Program are stored, processed and used for the purpose of the Program functioning. These data can be provided to the partner companies and other third parties in order to carry out advertising and marketing activities, as well as for mailing campaign with information materials related to the Program.
The following terms and definitions are used in these Terms and conditions:
NordStar - NordStar JSC.
Active Participant - is a participant of the Program who has collected at least one (1) Flight segment on his account during the year for traveling by regular NordStar flights at the tariffs involved in miles crediting. Flights performed prior to the date of registration in the Program are not taken into account.
Bonus Miles - miles that can be used only to receive Awards and are not taken into account for receiving Gold or Platinum status. Bonus Miles include:
Gold card – personal plastic card of EASY TO FLY! program Participant, issued by NordStar when the Participant reaches Gold status; it contains information about the Participant name and surname, Personal account number and the Participant status. Gold card is a property of NordStar and must be returned to NordStar upon reasonable demand.
Gold status - the status assigned to the Participant upon receiving 40,000 miles or after 40 travels by NordStar regular flights at the tariffs involved in miles crediting. Gold status permits the Participants to gain additional Status and Bonus miles and receive privileges when booking and using NordStar services. When Gold Status is reached, the Nickel Card of the Program Participant is to be replaced with the Gold Card.
Booking code - the letter designation of quota of places on the flight that corresponds to a certain tariff (RBD -reservation booking designator).
«EASY TO FLY!» (alternatively EASY TO FLY! program, or the Program) - the loyalty program for passengers using NordStar services defined by these Rules. The Program is managed by NordStar. Participation in the Program gives Program Participants the opportunity to collect miles for using NordStar services, and to use miles for purchasing certain services provided by NordStar.
Miles - payment units of the EASY TO FLY! program, credited to the Participants and used by them in accordance with these Rules. Miles are credited to the Participant for traveling by NordStar regular flights at the tariffs involved in miles crediting. Miles credited to the Participant can be used for receiving Awards within the Program, they are also taken into account for receiving or confirming Gold or Platinum status of the Program. Miles crediting is carried out in accordance with item 7.2 of this Rules.
Nickel Card – virtual Card of the Participant containing the Personal Account number assigned to its holder who wishes to participate in the Program until he is registered as the Program Participant. Nickel card is valid until Gold card of the Participant is received.
Nickel status - status assigned to the Participant after successful registration in the Program.
Password - a keyword or a set of characters; defined independently when registering in the Program; it serves to authorize the Participant in the personal account on the Program website. The Program participant shall not tell the password to the third parties.
Personal account (Participant's account) - account of EASY TO FLY! program Participant where the Participant’s personal data as well as miles credited and history of transactions (miles crediting and debiting) are stored. Number of the personal account is specified on the Card and in the personal account of the Program Participant on the Program website. Personal account number is the identifier of the Program Participant.
Platinum card - personal plastic card of EASY TO FLY! program Participant, issued by NordStar when the Participant reaches Platinum status; it contains information about the Participant name and surname, Personal account number and the Participant status. Platinum card is a property of NordStar and must be returned to NordStar upon reasonable demand.
Platinum status - the status assigned to the Participant upon receiving 75,000 miles or after 75 travels by NordStar regular flights at the tariffs involved in miles crediting. Platinum status permits the Participants to gain additional Status and Bonus miles and receive privileges when booking and using Y7 services. When Platinum Status is reached, the Gold Card of the Program Participant is to be replaced with the Platinum Card.
Flight miles – miles that can be used for receiving Awards within the Program, they are also taken into account for receiving Gold or Platinum status of the Program.
Flight segment - a non-stop flight from the departure point to the destination point. In some cases it includes intermediate landing without changing the flight number. For example, traveling from Krasnoyarsk to Moscow and back consists of two flight segments: one from Krasnoyarsk to Moscow, and the other one - in the opposite direction.
Awards - an award ticket, award upgrade and other services which can be purchased by the Participant in return for debiting miles from the Personal account in accordance with the Rules of EASY TO FLY! program.
Award flight ticket - a flight ticket for any NordStar regular flight which can be received in return for debiting a certain amount of miles from the Participant's Personal Account which corresponds to a 100 % discount to the flight ticket price.
Award upgrade - using of the credited miles for upgrading the class of service from economic to business class in case of confirmed booking issued according to the tariff permitted by these Rules.
Privileges - benefits, discounts, awards and/or services provided to EASY TO FLY! program Participants on a permanent or temporary basis in general or on a case-by-case basis depending on the Participant’s status in the Program.
Jointly operated flight (code-share) - is a flight performed within the code-share agreement between two airlines, according to which one of the Parties (the Marketing Carrier) has the right to sell tickets for the flight performed by the other party (the Operating Carrier) under the carrier's own code. Each Party introduces the jointly operated flight to automated booking systems under its own number.

Service center of the Program - the service department of EASY TO FLY! program participants, where the Participants information is stored and processed, and where they can address by phone or by e-mail: easy-fly@nordstar.ru
The Program Media - the Program website, electronic newsletters and electronic account statements are the official communication channels of the Program. Rules of promotional activities, special rules concerning other periodic opportunities for crediting and debiting miles, published in the Program media are annexes and supplements to these Rules.
Participant's Status – Participant's status reflects the Participant's activity level within EASY TO FLY! program and the level of privileges available as a result of this activity.
Status Miles - miles that can be used only to receive Awards and are not taken into account for receiving Gold or Platinum status. Status miles are credited to the Program Participants who are owners of the Gold or Platinum status for flights.
Transaction - crediting or debiting miles from the Participant's Personal Account of EASY TO FLY! program as a result of the Participant's actions aimed to collect or use miles for receiving Awards.
Participant - a person participating in EASY TO FLY! program who accepts and follows these Rules.
3.1.1. Participation in EASY TO FLY is individual. Any individual aged fourteen (14) and above can participate in the Program, taking into account the restrictions for young persons established by the provisions of articles 26, 27 and 28 of Part 1 of the Civil Code of the Russian Federation.
3.1.2. NordStar reserves the right to refuse any person to register as the Program Participant with no reason given.
3.1.3. It is necessary to register on the website www.nordstar.ru and get a Personal account number in order to participate in EASY TO FLY! program. Only one Personal account is opened for one Participant.
3.1.4. The participant is to specify real and valid information about his actual place of residence that is required to send him the Program Card. NordStar is exempted from liability for the impossibility to deliver the to the Participant in case the latter fails to fulfill his obligation to specify correct information about his actual place of residence. If the Card sent by NordStar by registered mail to the address specified by the Participant is not received (both when the conditions for receiving Gold Card were fulfilled and in case of subsequent delivery of Platinum Card), due to the discrepancy between this address and the address of the Participant’s actual residence, re-sending is possible only after paying the fee equal to one hundred (100) miles.
3.1.5. Only the Participants who provided all the necessary personal and contact details, including name, surname and date of birth, as they are recorded in the valid passport, have the right to require crediting Miles to their Personal Account and use the miles credited to their Personal Account to receive Awards. NordStar has the right to require confirmation of correctness of personal and contact information provided by the Participant.
3.1.6. Upon providing personal data, the Participant agrees that NordStar has the right to use them for realization of the Participant's interests within the Program. For avoidance of any doubt the Participant is hereby notified that, as part of the implementation of necessary actions for the Program realization, NordStar performs processing of the Participants’ personal data submitted during the registration in accordance with item 6.2.2 below. These actions are carried out by NordStar in accordance with subitem 5 of item 1 of Article 6 of Federal Law No. 152 “On Personal Data” of the Russian Federation. In the context of these Rules, any action (operation) or series of actions (operations) performed by NordStar with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data using automation means or without using such means are understood as the Participant's personal data processing.
3.1.7. The Participant agrees to transfer of his personal data provided to NordStar upon registration to the third parties - NordStar counterparties (including the cases when such transfer represents a cross-border transfer of personal data in accordance with Article 12 of the above-mentioned Federal Law), in cases when such transfer is necessary to realize the Participant’s interests within his participation in the Program, provided that such transfer and subsequent processing of personal data by the relevant third party will be carried out in accordance with the applicable law of the Russian Federation.
3.2.1. Registration as a Participant of EASY TO FLY! program is free of charge. By registering in EASY TO FLY! program, the Participant confirms his consent with the terms of the Program, including the consent to receive information about the Program by the contact data specified.
3.2.2. Registration as a Participant of the Program is carried out in the following sequence:
3.2.3. The Participant has the right to use the Personal account number received upon registration, which corresponds to the Participant’s Nickel, Gold or Platinum card number. The account number confer a right for crediting miles for traveling by NordStar regular flights.
3.3.1. Each Participant of EASY TO FLY! program can have only one Personal account in the Program. The Personal account number is also an individual number of EASY TO FLY! program Participant.
3.3.2. In case the Participant has more than one account in the Program, the accounts are to be merged. NordStar reserves the right to merge the Program accounts without prior notification of the Participant.
3.3.3. The Participant's account and the miles credited to it can not be merged with the accounts and miles of other Participants in EASY TO FLY! program or the participants in other incentive programs for passengers.
3.3.4. Number of the Participant’s Personal account is specified on the Card or in the Participant’s personal account on the Program website.
3.3.5. In case the Participant qualifies for Gold or Platinum status, the Participant's Card is sent to him; the card contains the following information:
3.3.6. Participants must either show EASY TO FLY! program Participant's Card or specify or personally enter the Personal Account number when booking and checking-in for NordStar regular flights.
3.3.7. The valid Participant's Card must be available for verification when using any services or privileges provided within the Program. If the Card is not provided by the Participant, the services may not be rendered.
3.3.8. The Participant's card is a property of NordStar. In case of the Card loss, the Participant sends a loss application to the Program Service center. The Participant must pay a service fee equal to one hundred (100) miles to restore the Card. In this case a new Card will be sent to the Participant within one (1) month starting from the receipt of the application and payment of the service fee.
3.3.9. In case of any suspicion of unauthorized use of the Personal Account the Participant must immediately notify the employees of the Program Service center by the telephone number specified in the Program Rules or inform the airline information service by the telephone number 8-800-700-8-007.
3.3.10. NordStar company reserves the right for periodic sending extracts with information about the Personal Account status and newsletters to the Participants.
3.3.11. Real-time information on the Personal Account status is available at the Participant's personal page on the Program website. One must enter EASY TO FLY! program Participant's number or e-mail address and password in order to get access to the personal page and information.
3.3.12. NordStar is not responsible for the unavailability of the account status information in case the Participant can not get access to NordStar website due to technical problems, the elimination of which does not directly depend on NordStar.
3.4.1. Password is required for the Participant to authorize on the Program website in order to obtain information about the Program Personal Account status, to view and change contact personal data, to enter information about unaccounted flights through the Program website, to issue Awards and perform other actions provided by these Rules.
3.4.2. The password is set independently when the Participant registers in the Program.
3.4.3. The participant can change his password independently at his personal page on the Program website.
3.4.4. The participant must take all reasonable and necessary measures to exclude the possibility of unauthorized use of his Personal account, in particular, to ensure the Password and the Participant's Card safety and to restrict access to them by the third parties.
3.4.5. NordStar is not liable for any damage caused as a result of unauthorized access to the Program Participant’s Personal account by the third party using his Password.
3.5.1. Each Participant is responsible for the timely change of personal data.
3.5.2. Иthe Participant can change his personal contact details - phone number, address for correspondence delivery, passport data - independently on the Program website at his personal account.
3.5.3. Change of name / surname, date of birth, e-mail address is made only by the Program Service center employees after receipt of the Participant's written application, including electronically by e-mail; such change can not be made by the Participant independently on the Program website. The application for changing the surname / name must be accompanied by copies of the supporting documents (marriage/divorce certificate, copy of the valid passport, etc.) or their scanned images in case the Participant sends the corresponding application by e-mail. In case of changing the name new Card shall be sent to the Participant within one month starting from the date of receiving the application. Service fee for the repeated fabrication and sending the Card is not charged.
4.1.1. Miles are the main payment units in EASY TO FLY! program.
4.1.2. Miles are credited to the Participant for paid and actually performed travels by NordStar regular flights.
4.1.3. For crediting the miles to the Personal account the Participant should show the Card or tell his Personal account number when booking and paying for the flight ticket or service, or personally enter his Personal account number when booking the flight ticket or services on the NordStar website. Upon receiving the flight ticket or at the time of providing/registering the paid services the Participant must verify the correctness of the Personal Account number recording and the compliance of his name and surname spelling in the Participant's profile and on the ticket.
4.1.4. Miles for a flight or service are credited to the Participant's Personal account once and only within EASY TO FLY! program.
4.1.5. NordStar reserves the right to block or cancel any Participant’s Personal account in case the Participant has collected miles by ineligible or fraudulent means.
4.1.6. NordStar reserves the right to provide additional methods of collecting and debiting miles with regard to those ones specified in these Rules. Corresponding information about all the changes will be published on the Program website as well as in other Program media.
4.2.1. When traveling by Y7 regular flights, the Participant is credited with miles calculated as a percentage of the actual distance in miles between the departure and arrival airports, depending on the tariff and class of service specified in the flight ticket, in accordance with the approved tables of miles collection published on the Program website.
4.2.2. When the Participant flies on a route which includes flight segments of several air carriers (regardless of whether one or several tickets are issued for such flight segments), miles are credited only for the flight segments performed by NordStar.
4.2.3. When traveling using flight tickets with Award upgrade, forced upgrade or any other increase in the class of service not related to the Participant’s payment of the full difference between the economy class tariff and the affordable business class tariff, miles are credited according to the class and the tariff of the paid ticket.
4.2.4. Miles are not credited when traveling using Award tickets for NordStar regular flights.
4.2.5. Miles are not credited if certain booking classes are used, as well as tariffs with industry discounts, special NordStar tariffs, the terms of which stipulate that they do not participate in miles crediting, chartered flights, award transfers, flight tickets and services for which Participants receive Awards within other incentive programs.
4.3.1. Nickel status is assigned to the Participant after successful registration in the EASY TO FLY! program on the NordStar website and gives the opportunity to collect miles when traveling by NordStar regular flights at tariffs involved in miles crediting, and use the credited miles for obtaining Awards.
4.3.2. Gold status is assigned to the Participant upon receiving 40,000 miles or after 40 travels during the last two (2) years by NordStar regular flights at the tariffs involved in miles crediting in accordance with the rules of qualification for Gold status published on the Program website.
4.3.3. Platinum status is assigned to the Participant upon receiving 75,000 miles or after 75 travels during the last two (2) years by Y7 regular flights at the tariffs involved in miles crediting in accordance with the rules of qualification for Platinum status published on the Program website.
4.3.4. Miles are credited for travels by regular flights, including Y7 jointly operated flight with account of the provisions of paragraph 4.2.2 above.
4.3.5. Gold status of EASY TO FLY! program Participant is valid from the moment of crediting the amount of miles required for the acquisition of the Gold status to the Participant’s Personal account for two (2) years from the date of the flight which served as a transition to the Gold status.
4.3.6. Platinum status of EASY TO FLY! program Participant is valid from the moment of crediting the amount of miles required for the acquisition of the Platinum status to the Participant’s Personal account for two (2) years from the date of the flight which served as a transition to the Platinum status.
4.3.7. In order to extend Gold or Platinum status for the next two (2) calendar years, the Participant should fulfill the conditions similar to the conditions necessary for achieving Gold status within two (2) years starting the date of transition to the next status. If the conditions of collecting the required amount of Status miles or recording of status flight segments are not fulfilled during each next year, the Participant’s status is changed to one step below.
4.3.8. After Gold status assignment, the Participant receives an e-mail request for confirmation of the address specified by him during registration for delivery of the card. Within one (1) month after receiving confirmation from the Participant or specifying a new address, Gold card indicating the status in EASY TO FLY! program is issued and sent to the Participant. The Participant's Personal account remains the same. The Participant’s Gold Card serves as Gold Status identifier and the basis for granting the appropriate Privileges to the Participant (upon showing the Card).
4.3.9. After Platinum status assignment, the Participant receives an e-mail request for confirmation of the address specified by him during registration for delivery of the card. Within one (1) month after receiving confirmation from the Participant or specifying a new address, Platinum card indicating the status in EASY TO FLY! program is issued and sent to the Participant. The Participant's Personal account remains the same. The Participant’s Platinum Card serves as Platinum Status identifier and the basis for granting the appropriate Privileges to the Participant (upon showing the Card).
4.3.10. The participants of the EASY TO FLY! program with Gold or Platinum status, receive additional Privileges that are published on the Program website.
4.3.11. Privileges for Participants with Gold and Platinum status are available when traveling by NordStar regular flights at the tariffs involved in miles crediting, as well as by award tickets.
4.3.12. In order to receive the Privileges provided for the Participants with Gold and Platinum status, the Participant must show a valid Participant's Card that corresponds to his status and a personal identification document.
4.3.13. Gold or Platinum status is assigned to the Participant when the required amount of miles is credited to his Personal account, regardless of how many previously credited miles have been debited from his Personal account.
4.4.1. For automatic crediting of Miles the Participant must indicate/tell the Agent his Personal Account number when booking and, if necessary, show his Card when registering the services that give the right for crediting.
4.4.2. Miles are automatically credited to the Participant’s Personal Account within 3-7 days after the flight is completed, provided that the Participant's personal data on the ticket (Participant's Full Name and Personal Account number) coincide with the relevant data specified in the Participant's registration form. The exceptions are flights on the routes, where departure airports are not equipped with automated departure control systems. In this case, the Program Participant must independently inform the flights data in the Program website Personal area in accordance with item 4.4.4. In this case, the period of miles crediting can be up to forty-five (45) days.
4.4.3. The Participant must independently check his Personal account status, the correctness and the number of miles credited to him on the Program website. In case the information about one of the completed flights is missing on the Personal account, the Participant can request recovery of unaccounted miles using a special form in the Program website Personal area.
4.4.4. For crediting of unaccounted Miles for flights or recovery of miles that have not been credited for technical reasons, the Participant must fill in the corresponding form on the Program website specifying the route, the date of the flight, the flight number and the ticket number.
4.4.5. Requests for recovery of unaccounted miles for traveling by NordStar flights are admitted for examination within six (6) months starting from the date of the flight that gives the right for crediting miles.
4.5.1. All miles credited within EASY TO FLY! program are valid during the year in which the flight was performed or the service was rendered, and during the next calendar year.
4.5.2. In case the Participant is an Active Participant during the current year, the miles which expire at the end of the current year are extended to the next calendar year.
4.5.3. All miles with expired period of validity are canceled.
4.6.1. Miles can be used to receive EASY TO FLY! program Awards, including an award flight ticket for NordStar flights as well as award upgrade on NordStar flights.
4.6.2. Miles can not be transferred from the account of one Participant to the account of another Participant.
4.6.3. The list of Awards can be extended in comparison with the one presented in the text of these Rules, information on such changes will be published on the Program website and in other Program Media. Information on the number of miles required to get each specific Award is also published on the Program website and in other Program Information Media.
4.6.4. Availability of an Award may depend on the type of Award, as well as the date, season and the place of destination. NordStar does not guarantee the possibility of receiving any Award at any time.
5.1.1. If the required amount of miles is available on the Personal account, the Participant has the right:
The number of miles to be debited for issuing the Award is calculated on the basis of data on the directions listed in the table of Awards on the Program website.
5.1.2. The Program Participants perform booking and issuing the Awards in accordance with the procedure specified in items 5.5. and 5.6. of these Rules.
5.1.3. All miles used to receive a specific Award must be debited from one Personal Account of EASY TO FLY! program Participant. It is not allowed to pay one Award using miles from several accounts.
5.1.4. The Participant can issue an Award either for himself or for any other person indicated by him. Issuing Awards for another person is allowed no more than 5 times during each calendar year.
5.1.5. The issued Awards can not be re-registered to another person or be transferred and/or assigned to another person.
5.1.6. Awards can not be sold, bought or exchanged for tangible asset or other Awards. In case an Award is used in this manner, the Award can be cancelled, and the Participant who has performed the such actions can be excluded from the Program.
5.1.7. Within EASY TO FLY! program NordStar reserves the right to request confirmation of identification of any person who wishes to use the services of the Program or to issue an Award, and refuse to render the services if it is impossible to such confirmation.
5.1.8. If the Participant is legally incompetent, or its legal capacity is limited, the application for an Award must be formalized in accordance with the requirements of articles 1, 26, 27 and 28 of the Civil Code of the Russian Federation. In this case NordStar reserves the right to request additional documentation within EASY TO FLY! program.
5.2.1. Award tickets for NordStar flights can be issued in exchange of debiting the corresponding amount of miles from the Participant's account in accordance with the table of Awards on the Program website. Number of miles required for the issuing an Award ticket depends on the direction and class of service of the Award ticket.
5.2.2. Award tickets for NordStar flights are issued both as one-way tickets and return tickets.
5.2.3. All Award tickets are issues in electronic form (E-ticket - electronic ticket). The exceptions are departure airports which are not equipped with automated departure control systems.
5.2.4. Award ticket can be issued only to the Participant of EASY TO FLY! program taking into account the restrictions specified in item 5.1.4. The Participant who owns the Personal account from which miles are debited always appears to be the ticket recipient.
5.3.1. Award ticket for NordStar flights can be issued according to one of two booking classes - U and J.
5.3.2. Award tariff “U” provides for debiting miles for Award flight ticket issued for economic class of service, provided that the number of available Awards depends on the route and date.
5.3.3. Award tariff “J” provides for debiting miles for Award flight ticket issued for business class, provided that the number of available Awards depends on the route and date.
5.3.4. Number of miles required for issuing an Award flight ticket according to U or J tariffs is shown in the table of Awards on the Program website.
5.3.5. “U” and “J” tariffs can be combined in one Award turnaround flight.
5.3.6. NordStar reserves the right to introduce restrictions on booking the Awards including restrictions related to the routes and the dates of issuing the Awards.
5.4.1. Miles are debited from the Participant's account upon booking the Award flight ticket. Debiting miles from the account does not affect the Participant’s Gold and Platinum status.
5.4.2. ВIn case of voluntary refusal from flight by an Award flight ticket, debited miles can not be returned to the Participant. The Award flight ticket is valid for one (1) year starting from the date of issue. In case of involuntary return of an Award flight ticket, the matter is considered at the Program Service center on an individual basis.
5.5.1. Award flight ticket booking and issuing are possible only through the Program website. Booking is carried out in case vacant seats are available.
5.5.2. NNordStar reserves the right to request additional confirmation of the Participant's identification.
5.5.3. NordStar terms and conditions of air transportation are applicable to passengers transfer by Award tickets.
5.5.4. Airport fees and fuel surcharges can not be paid for by miles. Fees can be paid by one of the methods specified on the website and available at the time of request.
5.5.5. NordStar has the right to charge additional fees for issuing the Awards within the Program.
5.5.6. In case of voluntary refusal from flight by an Award ticket, airport fees and fuel surcharges can not be returned to the Participant.
5.5.7. Jointly operated flight are governed by the relevant Code-share agreements, that is why additional restrictions can be imposed on issuing the Awards for these flights.
5.6.1. Award upgrade can be issued through the Program Service center.
5.6.2. Award upgrade is possible only for NordStar regular flights and implies an upgrade of the class of service provided that there are vacant seats, in exchange for debiting miles in accordance with the table of Awards provided on the Program website.
5.6.3. Award upgrade is possible only for the tariff groups specified in these Rules (see the table of Awards on the Program website). Upgrade is not carried out for Award tickets and tickets, issued on the basis of special offers and tariffs specified on www.nordstar.ru website.
5.6.4. Conditions and limitations of the original (paid) flight ticket are valid after the upgrade. Miles for the flight using the Award upgrade are not credited within the Program.
5.6.5. Upgrade for open date tickets is not permitted.
5.6.6. Changes in transportation conditions are not performed for the flight tickets issued with Award upgrade; a refund can be made under the terms of the originally paid tariff during the validity period of the ticket. In case of voluntary refusal from the flight using a ticket with Award upgrade, miles are not returned to the Participant.
5.7.1. In case of NordStar flight cancellation, the passengers will be directed to the nearest available NordStar flight.
5.7.2. In order to refund the miles in case of NordStar flight cancellation, the Participant must make a request for the unused miles return to the Program Participant account through the Personal Area. The Participant should provide a brief description of what happened and attach a copy of the flight ticket and a copy of the boarding pass (if check-in was performed) to the request, and send the request to the Program Service center within ninety (90) days starting from the date of the flight cancellation.
6.1. NordStar reserves the right to cancel or change the entire Program or its part at any time, either with prior notice or without it. These changes come into effect after posting relevant information on the Program website. In case the Program cancellation, all Miles collected by the Program Participants can be nullified. The airline is not liable for any losses or damages resulting from the Program changes or cancellation.
6.2. When acting within the framework of the Program NordStar reserves the right not to send information materials related to Program to inactive Participants.
6.3. NordStar flights destinations network and schedule can be changed at any time. The Participant can view this changes on NordStar website.
6.4. NordStar can modify and exclude any tariffs, awards or services from the Program. The Participant can view this changes on NordStar website.
7.1. NordStar reserves the right to exclude any Participant from the Program, to withdraw the Participant's Card and to cancel all miles credited to him in case of violation of the Program Terms and conditions by the Participant. Among other things, the basis for the Participant’s exclusion may be the publication of advertisements about purchase/sale of miles, flight tickets with or without the airline logo in open Internet resources by the Participant (or on his behalf).
7.2. The Participants of EASY TO FLY! program are required to strictly comply with the Program Terms and conditions, as well as to comply with all timeframes described in the Program. The Participant must review the Program Rules periodically with respect to viewing the amendments made.
7.3. If the Program Participant performs any transactions with miles or Awards (purchase, exchange, merge, theft) on no grounds provided in these Rules, these miles will be nullified and the Awards will be canceled.
7.4. The persons who sell or change the Awards are liable for losses and expenses incurred by the company and are obliged to reimburse these expenses.
7.5. NordStar reserves the right to check the accounts of EASY TO FLY! program Participants including temporary suspension of the account as well as partial or complete restriction of various transactions.
8.1. All relations between NordStar and the Program Participants are governed by these Rules, NordStar regulations for passengers and luggage transportation and Air transportation agreement posted on the NordStar website. With regard to the issues not covered by these normative documents and NordStar transportation Rules, the relations between NordStar and the Program Participants are also governed by applicable law of the Russian Federation, taking into account conflicts-of-law rules. In case the provisions of NordStar Rules and regulations contradict the current legislation, the current legislation of the Russian Federation is applicable.
8.2. In case the legislation of the country of citizenship of any of the Participants provides for special requirements and/or restrictions regarding the use of loyalty programs similar to the Program, NordStar has the right to modify and/or supplement the provisions of these Rules for such Participants, taking into account the requirements of the relevant legislation.
8.3. Legal venue for resolving possible disputes arising within the Program is located at bldg. 2, Staropetrovsky passage, 11, Moscow, 125130, Russia.
8.4. Unless otherwise provided by these Rules, issue of concern related to participation in the Program are resolved using the complaint procedure.
8.5. The Participants complains related to their participation in the Program are sent in a written form to the Program Service center through the contact form on the Program website.
8.6. Responsibilities for damages caused to the Participants when exercising their rights related to participation in the Program are regulated by applicable norms of international law and relevant national legislation, as well as by the rules of respective air carrier.
