4.1. Rights of the Carrier and a Passenger

4.1.1. The Carrier may settle its own air transportation regulations. These Regulations should not be in conflict with General Air Regulations and lower level of passenger service. The carrier’s Regulations may be amended without the carrier’s notifying passengers, provided no such amendment is applied to a passenger after concluding a passenger air transportation agreement.

4.1.2. The carrier may cancel or delay a flight stipulated in a ticket, change aircraft type, change a transportation route, if it is urged by terms of flight safety and/or air safety and upon request of state authorities pursuant to their competence. In case of changing aircraft traffic schedule, the carrier should take all possible measures to inform by any available means passengers, with whom a passenger air transportation agreement has been concluded, about the change of aircraft traffic schedule.

4.1.3. To ensure flight safety, passengers and aircraft crew life and health security, prevent unlawful interference with civil aviation activities respective competent authorities and the Carrier’s authorized agents may perform personal inspection of passengers, carry-on luggage, baggage, cargoes and aircraft onboard stocks.

4.1.4. If limitations on aircraft commercial loading, settled to ensure flight safety, are overcome, the Carrier may at its own discretion decide which of passengers and what baggage should not be transported by certain aircraft.

4.1.5. The carrier is entitled not to perform baggage transportation until all relevant rates and charges are paid.

4.1.6. A passenger has the right for truthful and full information on transportation terms, including information on:

  1. veterinary, phytosanitary and other types of control pursuant to legislation of the RF;
  2. the Regulations and procedure of pre-flight and after-flight inspection of passengers and baggage;
  3. terms of service aboard aircraft;
  4. aircraft type. 

4.1.7. A Passenger has the right for:

  1. transportation performance along the route stipulated in a itinerary receipt according to reservation and service class;
  2. providing a seat in a cabin according to reservation and service class;
  3. transportation performance within the term stipulated in a itinerary receipt and schedule, because during transportation the carrier is responsible for delay in passenger delivery;
  4. full or partial repayment of money sum for unperformed transportation or for change of service class;
  5. provision of a complex of services aboard an aircraft depending on an aircraft type and equipment, flight duration, time of a day during which the flight is performed and service class stipulated in a itinerary receipt. The scope of services and procedure for their provision is determined by the carrier’s Regulations.
  6. provision aboard an aircraft of:
  • information on flight terms and general Rules of Passenger Behavior aboard an Aircraft, location of regular and emergency exits, procedure for leaving an aircraft in case of emergency and location of personal protective equipment and inflatable escape chutes in an aircraft cabin;
  • medical first aid;
  • on flights on aircraft Boeing 737-800 and 737-300: beverages if an aircraft flight duration is under three hours, cold meals and beverages if an aircraft flight duration is from three to four hours, hot meals and beverages if an aircraft flight duration is over four hours and further every four hours during the day time and every six hours during the night time;
  • on flights on aircraft ATR 45-500: beverages if an aircraft flight duration is under three hours, cold meals and beverages if an aircraft flight duration is over three hours.

4.2. Obligations of the carrier

4.2.1. The Carrier shall:

  1. The carrier is obliged to preserve a passenger’ life and health;
  2. The carrier is obliged to arrange, support and perform passengers and baggage transportation by regular flights within terms and under procedure settled by a passenger and baggage air transportation agreement;
  3. The carrier is obliged to prove a passenger a seat in an aircraft cabin according to service class;
  4. During reservation, ticket issue, check-in and service aboard aircraft, at service at the destination airport the Carrier is obliged to provide a passenger full and truthful information on air transportation terms.
  5. On Regulations for Transportation of Passengers and Baggage, pre-flight formalities and requirement on border, customs, immigration, sanitary and quarantine, veterinary, quarantine and phytosanitary and other control types.
  6. If a passenger declared a ticket issued incorrectly, the carrier is obliged to take immediately all measures within its control to find out the fact of air transportation agreement conclusion.
  7. In case of changing aircrafts traffic schedule the carrier should take all possible measures to inform by any available means passengers, with whom a passenger air transportation agreement has been concluded, about the change of aircrafts traffic schedule.
  8. In case of an interval in transportation through the carrier’s fault and in case of flight delay, flight cancellation due to unfavorable meteorological conditions, technical and other reasons or in case of a transportation route alteration the carrier should arrange for passengers a number of services set forth in Clause 8.5. at departure points and intermediate points.
  9. The carrier is obliged to accept for transportation baggage within free baggage allowance.
  10. If passengers travel in group, upon passengers’ desire the carrier is obliged to apply for them a sum of free baggage allowances for each of the passengers.
  11. Unification applies to free baggage allowance only. Baggage is filed for each passenger separately.
  12. If the carrier has not given a passenger baggage checked in at an airport to which the baggage should be delivered under a passenger air transportation agreement, the carrier is obliged upon a passenger’s written application, filed on the basis of a traffic document, take measures to search the checked-in baggage.

4.3. Passenger’s Obligations

4.3.1. A passenger is obliged to observe legislation of the Russian Federation, international treaties of the Russian Federation and legislation of the country in the territory, from the territory or through the territory of which a passenger, baggage is transported, regarding passenger, baggage transportation, fulfilling requirements on ensuring flight safety, air safety and requirements on border, customs, immigration, sanitary and quarantine, veterinary, quarantine and phytosanitary and other control types pursuant to legislation of the Russian Federation.

4.3.2. A passenger is obliged to arrive at a reasonable time to passengers and baggage check-in place to undergo settled procedures for passengers and baggage check-in, payment for excess baggage and/or other baggage subject to payment, undergoing inspection, etc. (hereinafter “Pre-Flight Formalities”) and to fulfill requirements on border, customs, immigration, sanitary and quarantine, veterinary, quarantine and phytosanitary and other control types pursuant to legislation of the Russian Federation and legislation of the country in the territory, from the territory or through it, and to arrive to a boarding place.

4.3.3. A passenger is obliged to arrive to a departure gate no later than a flight boarding time stipulated in a boarding pass.

4.3.4. In case of international transportation, a passenger is obliged to have duly filed travel and entry documents and other documents required according to legislation of the country in the territory, from the territory or through the territory of which transportation will be performed.

4.3.5. At check-in and/or baggage the passenger is obliged to present for weighing the entire baggage intended for carriage as checked baggage. When you register and/or the boarding gate a passenger at the request of the Carrier is obliged to present for weighing hand Luggage and also a backpack, a baby bassinet and a stroller when travelling with a child, intended for the carriage of, except items listed in paragraph 12.4.4. this rule.

4.3.6. In case of baggage transportation on a separate passenger seat a passenger is obliged to pay for separate passenger seat (s) for this baggage.

4.3.7. In case of air transportation of animals (birds) a passenger is obliged to ensure appropriate conditions of their transportation (see Clause 13.4).

4.3.8. A passenger is obliged to receive a checked-in baggage immediately after it is provided on the basis of identification tag portion.

4.3.9. A passenger is obliged to decide independently whether he/she is able to use air transport considering his/her health.

4.3.10. A passenger is obliged to observe Rules of Behavior aboard aircraft set forth in Clause 8.4.
